How much does attorney escrow cost in the Czech Republic, and what does it include?
From CZK 5,000 excl. VAT for amounts held in escrow of up to CZK 1,000,000. The price includes a dedicated escrow account, AML identification (anti-money-laundering checks) of the parties, communication with the parties and administration of the escrow until settlement.
The price does not include drafting the purchase agreement, the registration proceedings, certification of signatures or translations. We provide these separately or as a package. We can set up the escrow within 24 hours.

When is escrow money released when selling property in the Czech Republic?
Usually once the buyer's ownership has been registered in the Land Register. The Land Registry Office (katastrální úřad) may not permit the registration earlier than 20 days after the notice has been sent to the owner. Once registration is proven, we usually release the money the same day.

How long does a client have to notify construction defects in the Czech Republic?
Without undue delay after the client discovered the defect or could have discovered it with due care (Section 2618 of the Civil Code); for a building, no later than five years after acceptance (Section 2629). Different rules apply to consumers. Notify defects in writing, with a description.

Does the client have to pay for variations they did not approve in writing?
Sometimes yes, even without written approval. The Constitutional Court has accepted that work beyond the scope of the contract may be a separate performance. The contractor can then claim payment on the basis of unjust enrichment. The specific circumstances and the wording of the contract are decisive.
Is a design company (s.r.o.) liable for defective design documentation?
It can be. According to the Supreme Court (25 Cdo 3086/2024), a company whose business activity is design work must compensate damage caused by defective design documentation prepared by its shareholder – an authorised designer (autorizovaný projektant) acting on its behalf.

Is a monthly retainer better value for a company than an hourly rate?
Usually yes, if you have regular legal matters. This typically applies to companies with 10 or more employees. The monthly retainer, from CZK 35,000 a month, includes a dedicated lawyer and priority response.
