When escrow makes sense

Two typical cases

  1. Selling or buying property

The purchase price is released only after the ownership right has been registered. Neither party has to perform first, and if a complication arises, there is a legal solution. A flat, a house, a development project or a co-ownership share.

  2. B2B transactions

Transfer of a limited liability company (s.r.o.), investor entry, settlement between shareholders. The escrow is linked to the transaction documents, and the funds are released only once all steps have been completed.

Approach

How escrow works

  1. Consultation and draft escrow agreement

We clarify the subject of the transaction and the conditions under which the funds will be released. We prepare a draft escrow agreement.

  2. Signing and identification of the parties

Signing in person or under a power of attorney. We always carry out identification under the Anti-Money Laundering Act (AML), including for foreign clients.

  3. Receipt of funds into escrow

The buyer sends the funds to a dedicated escrow account opened solely for this escrow. Once the funds arrive, we promptly send a confirmation and an account statement.

  4. Release once the conditions are met

As soon as fulfilment of the agreed conditions has been evidenced (e.g. registration in the Land Register), we release the funds. Usually on the same day.

Frequently asked questions

Short answers

How much does attorney escrow cost in the Czech Republic?

The fee depends on the amount held in escrow: up to CZK 1,000,000, it is CZK 5,000 excl. VAT. For amounts over CZK 50 million, we set the fee individually. The price includes administration of the escrow, setting up a dedicated escrow account, AML identification and communication with the parties.

When is the money released from escrow?

Only once the conditions agreed in the escrow agreement have been evidenced; for a property transfer, typically after the ownership right has been registered in the Land Register. We usually release the funds on the same day.

Where is the money held during the escrow?

On a separate bank account in the name of the law firm, used exclusively for escrow purposes. The money does not form part of the attorney's assets.

What is not included in the escrow fee?

Preparation or review of the purchase agreement, the registration proceedings at the Land Registry Office, powers of attorney, certification of signatures, translations and apostilles. We can arrange these separately or as a package with a price agreed in advance.

Terms of service: terms and conditions. Purchase agreements are covered on our Buying property page. For developers, we also prepare the declaration dividing a building into units and set up the owners' association (SVJ).
